Monitoring consumption: By strapping this Scram device on someone's leg, officials can monitor the alcohol intake of offenders. Is this a good idea?
Courtesy Alcohol Monitoring SystemsThere’s a new tool for justice officials to use in dealing chronic alcohol abuser: the Scram. Scram stands for Secure Continuous Remote Alcohol Monitor.
It was recently featured in a medical column in the New York Times. Judges hoping to put some more death in the sentence for those involved with alcohol-related crimes order the convicted to wear a Scram on their leg for a prescribed amount of time along with a program of recovery treatment. The Scram senses the body’s intake of any alcohol by measuring air and perspiration emissions from the skin each hour. At least once every 24 hours, the wearer must download data the Scram has collected to a modem that reports the wear’s alcohol levels to a monitoring agency or probation officer. Should Scram show a level of alcohol use, which the sensors can gauge to within a blood-alcohol level of 0.02, authorities will follow up with the offender to see what happened.
In the time that the Scram has been used, authorities report that there’s been a high compliance rate among people not drinking. But occasionally there are misreads or misreports.
Consuming some types of baked goods, such as raisin bread or sourdough English muffins, have triggered Scrams to report alcohol use by an offender. And being an electronics-based device, malfunctions can occur.
On user of the device included in the Times story had two consecutive days of his Scram reporting alcohol use several months into wearing the device. A wary probation officer gave him the benefit of the doubt when he strongly denied any drinking, and further review found that a build up of sweat and grime under the Scram was causing the false alarms.
So what do you think? Is this a good use of technology to help people get over alcohol misuse? Proponents of Scram say that it helps enforce sobriety while the offender has time to learn and work a program of recovery. But is this an infringement of a person’s right to privacy? Does an alcohol offender give up some of his/her rights to privacy? How long should someone sentenced to wear a Scram have to wear the device? Are there better ways for dealing with this? SCRAM may be a good device to screen for alcohol use. Unfortunately, the legal system is using this device as the judge and jury to determine IF a person has actually been drinking.
A friend of mine recently had a false positive experience. He tested "positive" for drinking when he was at work. He was not notified of this event until 48 hours had lapsed, thus preventing him from seeking alternative testing such as a urine or blood test. The legal system refused to give him a polygraph, but did lock him in jail for 14 days. He is now out awaiting a hearing, but the system has strongly suggested that if he loses the hearing he will be incarcerated for an extended period of time. The maker of the SCRAM, AMS, will be bringing their top researchers to the hearing. Unfortunately, "experts" on the SCRAM are limited, and would cost my friend upwards of $10,000 for just one expert...a cost he cannot incur.
AMS is not accurately or fully disclosing the appropriate uses of this device. This should not be used as a judge and jury...yet our esteemed legal system has decided that unscientifically proven devices can and will be used to determine a person's future.
My husband was sound asleep when he was falsely accused. He had already been sober for many months before the bracelet had been put on him.(Arrested in 2007, but didn't go to court until 2008). He wasn't told for five days. He went to court and the judge who was in ear shot said to the lawyer,"He may be innocent, but I am not going to say that the device is defective, because then I cannot use the device anymore." My husband wound up in jail anyway, Meanwhile our whole family lost our home and he lost his job of 10 years. I would never recommend the bracelet to anyone. Waste of money and then you wind up in jail anyway.
I recently had to start wearing the scram device for 8 months. After the 1st week I tested positive for alcohol. I know for a fact I did not drink.I was not notified until two weeks later therefore making an 80 hr piss test no good. No one told me that propylene glycol could register. Now I am facing god knows how long not to mention I stay on egg shells everyday.
Has anyone successfully beaten the SCRAM?
the only way to beat this is to get everyone together. I am trying to do that through an email box called fightscraminjustice@gmail.com I was also convicted of a drinking eppisode on scram when I was not drinking. I am dedicated to getting the truth out about lazy lawyers, misinformed judges and a treacherous prosecutorial system.
There is so much money in this and most lawyers and the rest of the treatment field have an interest in keeping things the way they are. But more and more is coming out about this technology. It recently was tested by the Nthb and it found that its accuracy and sensitivity decays after about 14 days. But interestingly enough that was on a test sample of those who were drinking. They did not test it on the sample of people who were told NOT todrink. It showed that it had more of a problem with false negatives- did not pich up on drinking events over a .02 in almost 20 percent of the tests. So much more in the reports, you should read them. People who had the older version were wearing bracelets with a faulty o ring that caused water to collect on its sensor. Another faulty oring. The challenger was brought down by a faulty O ring.
Please email me if you have had a false positive and I can supply you info for your lazy lawyer who is too busy to sit down and learn about this awful technology.
I dont like this scram thing. This is not about me, its about my brother. its been almost 3 weeks now and my brother still in jail coz of this false positive result. My brother keep insisting I didnt drink I didnt drink. It came to my mind maybe he really did not drink. So I look on the website if the scram could make mistake reading. Now that I found out its positive that could make mistake.I called the lawyer if theres away to prove it , that my brother is innocent.
My son is facing a hearing with a rabid probation officer insisting that the SCRAM is "100% accurate". When my son told the judge that it is not, he was told to "shut up". We can't afford an expert to testify. Can you help provide info to our attorney?
My son is on scram and uses licoderm pain patches
on his arm, which has alcohol in them. The PO said
he had a .04 reading which i read that they could not
give out readings like this. its either drink or not drinking readings.
anyway the po knows he is on the patches.
The last time there was two cases and the scram
people never showed up so they had to drop the
cases.

I have been accused of tampering, jailed for proven Windex use cleaning my house, even though they said on the stand it was no way consumption I signed a paper that said I wouldn't use any product containing alcohol. Now last Wednesday they said I was drinking from 2:29 to 8:30 am the next day. I tried to tell them the modem kept dialing in on my business phone in the middle of my work day and that I had to unplug it 4 times and finally just started using my cell phone to finish work at 6:30. I then went in for my 126.00 dollar check up the following Monday and sure enough I get "what were you doing Wednesday from 2:29 to Thursday at 8:30 am. I asked them why they didn't have me come down right then and there to blow for proof or have me pee the next 2 days, no answer. Now I am going before the judge yet again to see if I am going to jail. I am fighting for my life and would appreciate anything you can help me or my lawyer with. Thank you Sandy

i have the schakle I call it.. It has put blisters on the side of my legs. I had to put triple antibiotic ointment around the braclet,, this is consider tampering. the inside of my left leg is bleeding with sores.
At his probation meeting on January 21st, my son was told that his SCRAM had shown alcohol positive 'all day' on December 24th. The probation supervisor told him that he could admit to drinking and spend two weekends in lockup, or if he contested it, they would lock him up until his court date. Needless to say, he wasn't left much of a choice. He has a family to support and cannot afford to miss work, and, ultimately lose his job. My son went to work on December 24th at approximately 5:00 a.m., and worked until approximately 4:00 p.m. He was not drinking. He works in an environment that contains many types of chemicals, and from my research on 'false positives', this could be a contributing factor. Also, he has worn the SCRAM for over a year. I also know that food can trigger a 'false postive' and it was Christmas Eve with employees bringing a lot of foodstuffs to work. In any event, is there any way to get the results of the test uploads at the time they are submitted? Knowing the pattern of the 'trigger' would help determine the cause. Finding out that you have given a positive read a month after it happens leaves you completely defenseless.
I think it is funny that you people are complaining about this device. I have been on the SCRAM device for 227 days and I have had not issues with false positives or sores. When there is any sort of alcohol reading, I am questioned within the first 24 hours of it having detected alcohol. The sores/rashes on your legs are from improper hygiene. I started getting a rash and then realized that I was not properly washing, rinsing or drying the area where the bracelet is. Once I started taking care of my leg and the device properly I have not had any other issues. This device is AMAZING!! For the people who have false positives, you are kind of asking for it. You are not to use or possess anything with alcohol in it; shampoo, body wash, perfume, NOTHING!! When you use some of these products with alcohol in them, you are just asking for it to detect alcohol. Is it worth using your favorite perfume and potentially have the device pick up some alcohol from the perfume? HELL NO, just stay completely away from it!!!! As for eating certain foods with alcohol, I have researched this and you would have to consume well over 200 chocolate donuts in one sitting to get a reading over .02. Even meals cooked with wine and things like that burn off the alcohol while it is cooking. You people need to get over it and STOP DRINKING!!!! It's your fault that you are put in this position anyway! The SCRAM makers didn't make you drink then drive or drink and be violent. It was your decision, GET OVER IT!!!!!!!!!!
Good for you that you have had a good experience with the scam bracelet. There are MANY problems with this device. To say that someone is quilty until they have the chance to prove themselves innocent is a violation of the 6th Amendment! If this thing was truly as good as you say, when a positive alcohol reading is detected, You should be told immediately so that you can obtain a blood test or some other type of proof that there is NO alcohol in your system or proof that the bracelet is accurate! They don't tell you, they just violate you! You find out weeks later. So, goody for you that you haven't had any problems. I see you've been wearing the scam bracelet for over 227 days.. hmmm, you must have been a repeat offender and your probably just now sobering up! Again.. good for you!
You are a silly goose! 2oo plus days huh.. well I have been wairing this gol-darn thing for a year and a half, and been sober that long. AND I am not a rootin'-tootin' poor decision maker who drank and drove my car. I wasn't violent. I just drank. My ex told a judge in family court that I drank and the very strict family court judge made me wair a SCRAM. Be more mature. Go to an aa meeting or two there young lady. Learn about the program. I bet you are already back out there, or with an attitude like yours you will be. By the way I had mine on for 14 months and then got a false positive. It happens. as for this device, best thing to say is be proud if one doesn't have to wear it. i've seen too many lives ruined by a drinking problem.
it may have been funny to some when tom hanks played a drunk on an episode of 'family ties', but not to me. there's NOTHING funny about a drinking problem.
my husband was successful on scram for nine whole months and only had two months to go. Now hes in jail for a positive alcohol reading that they are saying happened almost two months ago. Shouldn't be illegal... when you sign a contract with a handbook that says "that you agree to report for follow up testing in the event that the monitoring equipment detects a positive use of alcohol". I can't believe they can just assume he was drinking when they didn't call him to report for testing! Does anyone know a good defense for this type of situation?
the SCRAM device is only a baby sitter if you think about it how about you intellectually stop drinking a driving. If you wanna go kill yourself go do it but don't but another innocent driver at risk, you pay the price so stop complaining at least you unfortunately still have your small brainless lives left. Just do us all a favor go to jail, we don't need any more drunk divers.
This device is not just for DUI's or habitual drinkers. My 19 year old son wore one for two weeks for a FIRST time underage drinking charge. He wasn't driving, wasn't anywhere near a vehicle.
I have many DUI's, and think this is the best thing to keep me sober. I have been to 3 different twenty-eight day treatment centers, counceling, AA, other monitoring, but did not stay sober. With this newest device I know if I drink, I will go to jail. I can not deal with that. While I am on this system I can not drink and drive. This should please the judge, the public, and me because I now desire rehabilitation. This is much easier for me to become a "good" citizen, by working, family, and a great deal of other things, I only now have discovered. I guess it is like a big brother, because without it I have not been strong enough to stop drinking. oh well. good luck to everyone
I don't think I like this kind of monitoring, it almost takes your freedom in a way. I think people would feel more comfortable without it and I don't think it's that necessary after all. If you tell your doctor you are sober but you still drink a medical check can bring out the truth so you have no interest in telling lies.
One of the main ideas behind the imposing of criminal penalties is to take away someone's freedom after committing an offense. They've demonstrated that they don't understand how to responsibly use the freedoms most of us enjoy.
While I don't want anymore drunk drivers on the road either, the only difference between those who are sentenced to SCRAM and probation, and the others here who are apparently self-righteous, is the fact that the first group got caught, while those of you in the second group did not (or haven't YET).
If you have even had "a couple" of drinks and driven just two miles, you are just as guilty as those with a SCRAM. You simply have gotten away with it, period. And pointing out others' faults just makes your own faults shine through. So while "we don't need any drunk drivers," we also don't need any people who get off to making those with an addiction feel worse about themselves than they already do.

Thank You for saying that, I have been wearing this SCRAM bracelet for a little over a month. The only thing that gets me with this thing is I can't go to the Beach or swimming in a pool with my family with this thing. It cannot be submerged at all. If it is and no longer works then I have to pay $1700.00 for the replacement of the bracelet. I am taking my punishment, but isn't this going a little far by telling me I have to stay out of the water, (Hell I Live in Florida there is nothing else but water). Another thing is I clean beer tap lines for a living try getting around that without alcohol getting on you.
So I know I made a mistake and chose to drink and then drive, but this scram is rediculous. Ive been on it for about a total of 3 months now and have gotten about 5 alerts and every time they get an alert they say I have to keep it on longer, yet they can't prove whether it was consumption or not and that I am the only one that truly knows if I have been drinking or not. That's the stupidest thing I've ever heard. I'm paying $77.00 a week to be on this thing and they should be able to prove if I have been drinking or not before they punish me more. I live in America isn't it innocent til proven guilty well they obviously cant prove anything, so I'm obviously innocent. They should find something truly accurate before they put it to use on people.
Try paying $70 a day for the thing. That's what I'm paying...and I wasn't even caught drinking and driving. I came out of a place, sat in my car, knew I was too drunk to drive, put my keys in my purse, and was waiting for someone to come pick me up. I do agree we need to get drunk drivers off the road, but this SCRAM device is ridiculous!!!!
I have been had the SCRAM device on for about a month. No one has told me about any problems, but after reading some of these posts, I wonder if I will be held accountable for an infraction in the future. I have been very careful about (not only not drinking of course!) not using perfume or perfumed lotions or body wash and wearing gloves when using cleaning supplies. I have religiously washed under the device with a washcloth daily (as shown in the video) and don't have any problems with a rash. I was stopped for a DUI and this is the only time that I have had any problems with the law. As a punishment for my 1st offense, wearing this shackle to me is very extreme. I pay $15 per day, for 90 days. Over $1500 plus my attornet, $3500 plus probably a fine of $1000 for a grand total of $6000. I did not commit any other crimes, was not speeding or driving badly. I just think that it is a good idea for a repeat offender, but way too harsh for the initial punishment. I can't work out, swim with my kids, take a bath, receive the wine at communion when I go to Mass, I don't even want to have sex with it on. So it affects my entore life and I find it very depressing. Yes, I made a mistake, driving, but this seems way out of line for the punishment.
Just stay away from alcohol entirely. Don't go to bars or be around others drinking. I was ordered to wear my SCRAM for 2 additional months because of a "confirmed consumption." I was at a small, 1 bedroom apartment with others who were drinking. They all knew I had the SCRAM on and wouldn't be drinking. They all wrote letters on my behalf. All of these people are highly educated with good jobs and no criminal records. The prosecutor didn't care. He still believes the SCRAM detected alcohol. The SCRAM is a good idea but they need to admit that it is not perfect and this needs to be realized.
hey, i have had this thing on for 4 months, and 2 too go. The only way people are failing is simply because they are drinking, or not watching what products they are using. I will tell you cranberry juice and any bread with yeast might set it off. The juice ferments in your system and the bread breaks down to alcohol when fermented.. So if people are tellin you its a false reading, IT"S NOT. they lied to you and had a drink at some time or used something they shouldnt have been. i have been on prob. for 4 years and wanted to go out for one night with friends as sober driver, it was a mistake, but the scram did not pick it up. Like i said dont try it.
Can anyone tell me if there is any way to swim with the SCRAM unit? It is summer in Arizona and it is beyond hot. Can I wrap it with anything for 10-15min to swim? Does it have a depth perception? Is there anyone who has water damaged a SCRAM unit?
The issue isn't drinking. I don't have a problem staying sober, I am currently on probation, PO gave me breathalyzer after I had 3 drinks after work & immediately assigned me to this program. Yes, it sucks, but I'd like to be able to boat, swim, waterski, & all of the other summer things I have always enjoyed sober with my friends and family.
If there is anyone who has some advice to offer, I'd really appreciate it!

i be;eive that punishment is necessary, but this SCRAM bracelet might just be a little too harsh and after reading more about it, it"s obviously not at effective as they may have thought it would be. maybe things should just be cleaned up a bit
I read that the sores are from poor hygiene. The rash maybe, but in my case the sores were actually abrasions from the 8 ounce object continually pulling on my leg with every step. Two of 18 wearers in the PIRE research sustained these abrasions, not rashes! Fact is using the device in the manner they do is a complete violation of the Sixth Amendment-Notice of Accusation, but those who oppose me seem to prefer security over liberty.
Am I the only one? I was not convicted of any crime, but was ordered to wear the device as part of a divorce decree ruling. My ex-wife complained about my drinking habits and the judge ruled that I have to wear the device whenever I have the kids - every other weekend. I can't swim with them, am embarrassed to be in public in the summer, etc. The ruling is for an indefinite period of time - basically, it is on me to go back and fight for it to be changed. Also, I am now starting to travel on airplanes more frequently - and at times when I can't get the kids unless I have the device while traveling. Has anyone worn this through airport security? Have you had trouble explaining the device to airport screeners?

Yes the SCRAM can detect alcohol back 10 hours, but only if you had a large amount of alcohol to drink. For it to go back 10 hours you would have consumed at least 10+ drinks and had a BAC of likely .15+ depending on weight and a few other factors.
I have a false pos. for tampering, for 8.5 hours, while I was asleep. My PO says I'll go to jail for 6 months for this. I sleep alone. I live alone. NOW WHAT??????? How do I fight this? Any help out there?
Okay for those of you who have violated SCRAM and did NOT drink please let me know what products you were using, I am a PO who, although I trust the SCRAM's that I have installed on people and have not had a positive reading from alcohol that the person did not admit to drinking, or did not fail a subsequent test, I want to try this thing out for myself and see what kind of readings I get drinking and not drinking. Let me know. For those of you who have true positives and were really drinking, I do not have sympathy for you, you do it to yourself. For those of you who have true false positives I can assure you that it is our worst nightmares as PO's to file on someone who is trying to make a change in their lives. I know that there are several people who get sent back to court and did not do anything wrong, but there is also a lot of people who are full of crap and wont address their addiction. It's not right, but we do our best, the reason for this research. I will also be testing ways to tamper with the device, so if anyone has ideas for that please let me know.
Anything for research, first of all let me say I believe this Scram bracelet should ONLY be used as a SCREENING device. PO's are being notified day's after the positive is read. Some modems only "REPORT" every other day, some "report " when their R.O.M. gets 3/4 full (about 4 days) Even if the person is downloading every night to the modem. This doesn't give anybody a chance to "pove" anything. That's the way Scram wants it, can't prove the bracelet wrong or right or the person. With 102,000 bracelets being used there would be over 70 downloads a min. in a 24 hour period. The fact they only have 104 employees, that means about 34 per shift, watching 33,600 downloads. There are to many things that send a false test, to list here. Windex, Nyquil, gasoline, hairspray, food. Dead skin, rash, blisters, lint, soap scum, will send a false tamper. The list goes on and on, you would have to live in a bubble not to send a false positive sometime. Scram says 1 in 1600 is a false positive. Uhm...lets see here 102,000 on scram being tested twice a hour in a 24 day, that's 4,896,000 tests, with 1 in 1600 being false, that's 3,060 false test a DAY! NOW THAT IS JUST WRONG!!! Would you get on a plane if you knew that 1 in 1600 would crash!
The first test I would try is as soon as it's put on, put a sock between the bracelet and your leg, that's so when it takes it's first "bench mark" you already have it blocked, and that's where Scram will set all the "numbers " from. The next test is: Put three layers of siranwrap under the bracelet before it takes a "bench mark". Drinking: Scram admits, they only catch about 86% of the drinking. If you eat a full protien filled meal and drink a full volume drink (ie:beer) at one a hour, it will not show up. Next: have about three 100% alcohol drinks, then in 45 mins put some gasoline around the bracelet, it will know it's gasoline, because it will spike off the charts and lasts along time.
I think, Scram is not the "Be all Know all" there is another company coming out with a monitor and GPS that sends alerts and where they are in real time, that way, you get to know in real time if they are drinking, and if they are, send them to jail. Hope this helps!

This device is HORRIBLE! I have had nothing but problems after the first month. From changing the bracelet twice and the battery 3 times,to it reporting that I have been drinking at times I have proven I am at work (I am a bartender), I am constantly worried and thinking about it. I have gone in front of the judge also, as they threatened to put me in jail after the divice reported alcohol for 5 (yes 5!) days straight. Also, while I was waiting for court, the bracelet reported I was drinking. Luckily, they had me submit to a breath test and, viola! All .000's! The kicker for me- I haven't even been convicted of anything yet! My court hearing is in February and this bracelet is a condition of my bond. Seems I have been found guilty until proven innocent.
Now don't go assuming you know anything about me or my case or for that matter, my past. I will not discuss it here because I am waiting for a trial by jury. So I don't want any rude or degrading comments. I am just posting some horrible, stressful results from an unreliable MACHINE.
I was fitted for the scam bracelt on 7 Oct 2009. On Christmas day from 1PM till 8AM the device spits out a reading of "tampering". Some 70 plus days had elapsed without incident and then it gives a false tampering reading. 4 days later while attending one of two weekly mandatory AA meetings, the device again gives a reading of false tampering. I have witnessess on both occasions when this device decided to say I wasa tampering with it. I now along with my lawyer has to prove to the judge that I did not tamper with this. My sentence from my ever assuming PO is to wear it another 30 days for nothing I did wrong. I would be interested to know how many others are getting these readings while it's this time of the season where it is dry and your skin is flaky and what this is doing to the sensor? Of course they treat a tamper as a drinking event!! Wish I know how it would have tasted as I have completely abstained from any alchol since 1 Oct of 09.
What Nik said is nearly identical to my situation. I am a college student who lives with 3 roommates who are all of legal drinking age. They know about my bracelet and the situation, but have drank in the house on several occasions since then. My issue is I have a lease for a year of this place, so I am stuck. I cannot drive and have no where else to go. One time there was a party there and there was a reading from the moment I got home from work until I showered the next morning. Not only did this completely anger me because I virtually had no control over my situation other than to try to find a place to be. The court has told me that since I have roommates they are not going to charge me if alcohol is present in the house, and they actually 'let me off' for this one, but said if there is any other reading no matter what I am going to jail. This thing has literally made me depressed. I am constantly worried about going into rooms where people have recently used hand sanitizer. I have very sensitive skin so when I shave I get razor burn really bad and the alcohol after shave is the only thing that prevents this razor burn. So now I am stuck with dry, flaky skin, and razor burn all the time. It is a constant stress and the fact that it costs $360 a month is absurd. I am wearing it as a condition for my bond where if I wear it until the judge decides to take it off (no more than 6 months) they will drop my OVI charge. I have had it on for 75 days now, and wish I would have just taken the OVI charge because it would have honestly been less stressful. The only reason I took this option is because I am young and do not want my insurance to be even higher than it is! I will also not go into detail about my case, but I will say I will never drive after having even a single beer, and I will rarely drink at all any more. I have come to the point where all of my paycheck goes to this, and I have extra student loans out paying for rent and food and other necessties. I believe that this device is unconstitutional and if I had more time/money I would hire a lawyer to help me fight it for that purpose and get them completely banned
I had one on for 120 days, had no false positive for alcohol, but had one for tampering, They are not water proof, just water resist. Judge says they are having alot of problems with water gettting inside, so he let me off.
If you get them banned, then we all would be in jail. I think they have the right Idea, but just to use them as a screening device. When you want to bitch about this thing, stand in front of a mirrow, because that's the real person that put it on YOU.
im from oregon and got a dui in idaho and the only way i could bond out was with court compliance scram now i am stuck in idaho with nowhere to live and they are saying that it showed alcohol last month and i will have to go to a order to show cause hearing. i need to go home for work and my kids can they hold me in idaho? oh and i have not drank at all since having this anxiety strap on. about 120 days so far trying to get thru court and my next date is not till may
